Terms of service
These terms govern the use of MotoTrails, that is the mototrails.app website and the app for iPhone and Android, provided by Emanuele Chiavelli ([email protected]). By creating an account or using the service you accept them. If you do not agree, do not use MotoTrails.
1. The service
MotoTrails is a logbook for motorcyclists. It lets you record and import GPS tracks, see them on a map, find them again in your archive, export them as GPX, share them with a link and, where available, plan a ride and follow it with the app's navigation.
MotoTrails may change at any time, even without notice: we may add, modify, suspend or remove features, screens, maps and data. Some features, such as the route generator, are only available in certain countries and may not be available to you. Your right to export your rides (section 8) does not change.
2. Riding safely
Do not use the app while riding. Start, stop and check the recording while stationary, mount your phone securely and always follow the road rules and signs.
Ride guidance, navigation, tracks, times and points of interest are indicative: they may be inaccurate, incomplete or out of date, and they do not guarantee that a road is open, passable, suitable for your motorcycle or safe. The decisions you make while riding are yours. GPS accuracy depends on your phone and on coverage.
3. Account
- You must be at least 14 years old.
- You sign in with Apple, Google, or email and password, through Google's Firebase service.
- You are responsible for what happens with your account: keep your credentials safe and write to us if you think someone is using them in your place.
- An account is personal; do not transfer or share it.
- You can delete your account at any time, from the app or the website. Deleting it removes your rides, points, shared links and the GPX files linked to them.
- Support. To resolve a problem you report to us, the service administrator can view your account as you see it. This is read-only by default; changes are enabled only when needed to resolve your request, every such access is logged, and it gives no access to your password or payment methods. By accepting these terms you acknowledge this; the details are in the privacy policy.
4. Your content
Tracks, titles, notes, points of interest and favourite places stay yours. They are private: only you can see them, unless you share them.
You only give us permission, limited to what is needed to make MotoTrails work, to keep them, process them (for example to recognise the roads you rode) and show them to whoever opens a link you created. The permission is not exclusive, it does not let us sell them or use them for other purposes, and it ends when you delete the content or the account.
Only upload tracks and content you have the right to use; for GPX files received from others, make sure you are allowed to upload them. Do not write other people's personal data in your notes.
5. Sharing
A share link shows whoever receives it the stretch of track, the title and the points of interest you chose, for as long as the link is active. The link expires after 30 days; you can renew, deactivate or delete it whenever you like. Whoever has already seen the link may have saved or copied what they saw: we cannot delete it from other people's devices.
Think about what you share: a track can reveal where you live or work. This is why you can hide the first and the last stretch of the route.
6. Aggregated data
To improve the route generator we use aggregated data about the roads ridden. How it works, on what basis, and how to turn it off is explained in the privacy policy.
7. Subscription and prices
- Free trial. As soon as you sign up you can use the whole service for 30 days or up to 5 rides saved to your archive, whichever limit comes first.
- Subscription. After the trial, saving new content to our server requires the annual subscription, which renews automatically, at the price shown in the app and in the store before you buy (€7.99 a year, or the equivalent amount in your currency, taxes included).
- You buy only inside the app, through your Apple or Google account, and the payment is handled by Apple or Google. The subscription is tied to your MotoTrails account: it works on all your devices and on the website.
- Renewal and cancellation. The subscription renews every year unless you turn it off in your Apple or Google settings at least 24 hours before the end of the period. Cancellation takes effect at the end of the period already paid, which you can use to the end.
- Refunds and withdrawal. Refunds and the right of withdrawal are handled with Apple or Google, under their rules; we neither see nor can refund the payment. These terms do not limit the rights the law gives you as a consumer.
- Price changes. If the price changes we will tell you beforehand, and the new price applies from the next renewal; you can cancel at no cost before it applies.
8. What always stays free
Even without an active subscription:
- recording a ride: the app never refuses to record;
- viewing and exporting as GPX every ride already in your archive;
- opening links shared by others;
- managing your account, changing settings, deleting your content or the whole account.
What happens to a ride recorded without an active subscription. The ride stays only on your phone and is uploaded to the server automatically when the subscription resumes. Until it has been uploaded it is not part of your archive: you cannot open it, export it, share it or see it on the website, and you can only discard it. If you uninstall the app or clear its data before the upload, the ride is lost and we cannot recover it.
Without an active subscription you cannot save new rides to the server, import GPX files, create or edit points of interest, create share links or save rides from the editor. Your data is not deleted.
9. What you may not do
You may not:
- use the service for illegal activities, or to follow or monitor other people without their consent;
- try to access other people's accounts or data, or get around the security measures and the trial limits;
- overload the service, extract data automatically (scraping) or reverse engineer it;
- resell the service or its features, or harvest other users' tracks in bulk;
- upload unlawful content or content that infringes other people's rights.
In case of a breach we may suspend or close the account, letting you know where possible and telling you the reason. If the closure is not due to a breach on your part, we let you export your data.
10. Maps and third-party data
The service uses maps, road data and services provided by third parties, including OpenStreetMap (© OpenStreetMap contributors) and the providers of base maps and of sign-in. They are subject to their own conditions; we do not control them and we do not guarantee that they are correct or always available.
11. Intellectual property
The software, the brand, the texts and the graphics of MotoTrails belong to us or to our licensors. We grant you a personal, non-exclusive, non-transferable licence to use the service under these terms.
12. Availability, warranties and liability
We do what we can to keep the service running and the data safe, but we cannot guarantee that it always works, without interruptions or errors, and some maintenance downtime may be needed. Make and keep a copy of the GPX files you care about: you can export them whenever you like.
To the extent permitted by law we are not liable for indirect damage, for lost profits, or for loss of data caused by events beyond our control. This exclusion does not apply in cases of wilful misconduct or gross negligence, or to personal injury, and it does not limit the statutory warranties and the other rights the law gives consumers.
You use the app while riding at your own risk, within the limits allowed by law.
13. Changes and closure
We may update these terms: significant changes will be notified to you (in the app or by email) at least 30 days before they take effect. If you do not agree, you can stop using the service and delete your account; using the service after the effective date counts as acceptance.
If we decide to close the service we will announce it at least 30 days in advance, to give you time to export your data.
14. Governing law and disputes
Italian law applies, without prejudice to the rights the law of your country of residence gives consumers. For disputes with consumers, the court of the consumer's place of residence or domicile has jurisdiction. You can also use the European online dispute resolution platform (https://ec.europa.eu/consumers/odr). Please write to us first at [email protected]: in most cases we sort it out there.
The processing of personal data is described in the privacy policy.
